TERMS OF SUPPLY
These are the terms and conditions of supply for eu.mikesport.com(Site).
Your purchase of any of the products offered on this Site (Products) is subject to these terms and conditions and by placing an order for any Product you agree to be bound by them. You confirm that you are of full age or have received parental permission and that you have the legal capacity to enter into a contract and to subsequently place an order on eu.mikesport.com for Products. You should print a copy of these terms and conditions for future reference.
In addition to these terms and conditions, the following additional terms also apply to your use of eu.mikesport.com and its associated features:
We reserve the right to change these terms and conditions from time to time by changing them on eu.mikesport.com, although no such change will affect any order you have already placed with us.
ORDERING AND AVAILABILITY
Products may be ordered by clicking on the items you wish to purchase and then following the prompts that will appear on-screen. You may check and correct any input errors in your order up until the point at which you submit your order to us on the checkout page.
After placing an order, you will receive an email from us acknowledging that we have received your order and giving you an order reference number. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us. We are not obliged to accept your order and may, at our discretion, decline to accept any order. You do, however, acknowledge that by submitting your order, you enter into an obligation to pay for the Product(s) in the event that your order is accepted by us. The contract between you and us in relation to the Products ordered (Contract) will only be formed when we send you the Confirmation e-mail. After entering into the Contract, we will be under a legal duty to supply you with goods that are in conformity with the Contract. We will send you an email confirming when the Product been dispatched together with (where applicable) a tracking number.
The Contract will relate only to those Products we have confirmed in the Acceptance Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the acceptance such orders has been confirmed in a separate Acceptance Confirmation.
Our product and service offers apply for as long as they remain visible on eu.mikesport.com, except when special offers are available, in which case the term of validity of those offers will be stipulated on eu.mikesport.com. You are advised to check the availability of items on the relevant product information page.
If an item ordered is not available, we reserve the right to cancel the order, in which case you will be notified accordingly. If you place an order for several products one of which is unavailable, we will inform you accordingly. The rest of the order will be processed and dispatched to you within the time limit indicated on eu.mikesport.com.
eu.mikesport.com may also offer to replace the unavailable item with a similar item of similar quality with your prior agreement. In this case, if you then exercise your right to cancel the order after receipt of the substitute item, you will be required to pay the return delivery costs.
SHIPPING AND DELIVERY
Your order will be fulfilled by the delivery date set out on the Product page, unless there are exceptional circumstances.
Your order will be delivered to the delivery address (subject to the restrictions in the paragraph below). If you opt for this collection service, your entire order will be delivered to your chosen collection point and will be available for collection by you from the date specified by e-mail or notified to you by our courier. When collecting your order, you should take with you the e-mail, along with some form of identification (such as an ID or driving license).
Orders cannot be delivered to PO Box or similar addresses. Products comprised within the same order cannot be delivered to different addresses.
It is not possible to specify a precise time at which a delivery will take place. Please note that the courier may require deliveries to be signed for.
Deliveries will be made to your door. Our courier will not be responsible for any additional carrying, unpacking or positioning of Products. If you order a large, heavy or bulky Product, you are advised to check that its dimensions (allowing for packaging) will allow it to pass freely through the doorways and corridors of the delivery address.
If you are unable to take delivery of items, you will have a certain period of time in which to collect the Product(s) from the specified courier. Thereafter, the Product(s) will be returned to us and we will consider you have exercised your right to cancel the order.

RISK AND OWNERSHIP
Products ordered will be at your risk from the time of delivery or collection (as the case may be). Ownership of the Products ordered will also pass to you on delivery or collection (as the case may be), provided full payment of all sums due in respect of the Products, including any delivery charges, has been received.
PRICE AND PAYMENT
The price of Products is as quoted on eu.mikesport.com from time to time.
Prices include VAT but exclude delivery costs, which will be automatically added (at the cost shown) to the total amount due once you have selected your chosen delivery method.
Prices and delivery costs are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an e-mail Confirmation.
eu.mikesport.com contains a large number of Products and it is always possible that, despite our best efforts, some of the Products listed on eu.mikesport.com may be incorrectly priced. We will normally verify prices as part of our dispatch procedures so that, where a Product's correct price is less than our stated price, we will charge you the lower amount. If a Product’s correct price is higher than the price stated on the Site, we will normally, at our discretion, either contact you for instructions before dispatching the Product, or reject your order and notify you of such rejection.
Payment for all orders must be made by credit or debit card, via Paypal or by using Mike Sport Cash on Delivery service on the checkout page. We accept payment by most major credit and debit cards.
We will charge your credit or debit card to full payment as soon as we pick the first item of your order in the warehouse. If we unfortunately notice a lack of availability of one of the Products, we will advise you immediately and you will be able to choose between the cancellation of the whole Order or a partial refund.
Please note that in the payment transaction process, we ask the card issuer to ring fence (reserve) the amount of any order before we pick the first item. It means that even if you order one item, it may still appear that you were charged for it, but as soon as we inform the card issuer that the order has been cancelled, the funds will be released straight back to you.
You should be aware that online payment transactions are subject to validation checks by your card issuer and we are not responsible if your card issuer declines to authorize payment for any reason. Please note, it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.
Except in relation to certain Products set out below, you may cancel a Contract at any time before your order is delivered and up to seven (7) days afterwards.
If you cancel, you will receive a full refund of the price paid for the Products in accordance with our Return, Refund and Exchange Policy.
You may return or exchange most new items sold by Mike Sport within seven (7) days from your purchase, in the original unused condition and unopened packaging, unless there is a manufacturer defect.
Return and Exchange Conditions
- Return and exchange requests should be sent by e-mail to firstname.lastname@example.org within fourteen (14) days from the date of delivery
- In original condition & in original packaging
- Merchandise that has been worn, used, or altered will not be accepted for return or exchange
- Return and exchange is not applicable on underwear, swimwear, socks, and fragrances
For returns and exchange difference, we refund your order in cash for payments through cash on delivery, and to your card for card payments.
For cash refund and exchange difference, our team will contact you to schedule a visit.
We do not refund the original shipping and handling that you paid on the order.
If the return or exchange is a result of wrong item delivery, we will refund you the full amount of the purchase and shipping fees as store credit or exchange it with the right item.
Your card will be charged when you place your order. If we are not able to fulfill your order for any reason your card will be refunded.
You cancel your order free of any charge within two (2) hours from purchase time. Please send a cancellation email to email@example.com with your order number and details.
You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right to deduct the cost of any deterioration, up to the price of the Product, from the refund to which you are otherwise entitled.
You will not have any right to cancel a Contract for the supply of any of the following Products:
- perishable items;
- audio and/or visual recordings or computer software or hygiene-sealed items, in each case, where the sealed packaging has been opened; or
- products that have been personalized or made to your own bespoke specifications (if we offer such options);
- merchandise that has been worn, used, or altered;
- underwear, swimwear, socks, and fragrances
unless such Products were damaged or faulty when delivered to you or have been incorrectly delivered.
You will be responsible for the cost and risk of returning the Products to us, except in the case of items which we substitute if the precise Products you order are not in stock.
Nothing in this section affects your legal rights.
If you cancel a Contract between us within the fourteen (14) days off period (see above), we will process the refund due to you as soon as possible and, after the day on which we receive the Products back. We will refund the price of the Products in full (subject to any deduction we are entitled to make due to your use of or damage to the Products), including the cost of standard delivery. However, we will not refund your cost of returning the Products to us.
We will refund any money received from you using the same method originally used by you to pay for your purchase, unless agreed otherwise.
If any Product you order is damaged or faulty when delivered to you, you may have one or more legal remedies available to you, depending on when you make us aware of the problem, in accordance with your legal rights. If you believe a Product was delivered damaged or faulty, you should inform us as soon as possible, preferably in writing to firstname.lastname@example.org, giving your name, address and order reference.
Whilst we have taken reasonable steps to depict Products as accurately as possible through the photographs and other images featured on eu.mikesport.com, the detailing (such as color, pattern and texture, etc.) you see on-screen will depend on your monitor and, as such, may not exactly reflect the actual detailing of a Product when you receive it.
Any information on eu.mikesport.com regarding sizing of products is included as a guide only. If you are in any doubt as to the size of any product you require, we recommend that you contact us prior to placing an order (see Contact Us).
Certain Products sold on eu.mikesport.com are covered by a sales warranty for the term stipulated on the relevant product information web page and information accompanying the actual Product.

In no event shall we be liable to you for any business losses and any liability we do have for losses you suffer arising from any Contract shall not exceed the purchase price of the relevant Products and is strictly limited to losses that were reasonably foreseeable. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any Contract that is caused by events outside our reasonable control.
